An Abeokuta High court had earlier cleared the governor of charges against him by the anti-graft agency

The Chief Judge of the Ogun State High Court, Abeokuta, Justice O. O. Olopade, has granted the request of the Economic and Financial Crimes Commission (EFCC) to re-arraign the former governor of the state, Gbenga Daniel, over corruption charges.

The EFCC had through its counsel, Rotimi Jacobs filed an application for leave to prefer an information under section 340(2)(b) of the criminal procedure laws of Ogun State (2006), in charge No. EFCC/01/2012, in “Federal Republic of Nigeria versus Otunba Justus Olugbenga Daniel.”

The notice, which was dated March 30, 2012 and signed by the state Chief Judge, gave the Federal Government the clear to arraign the former governor, who was recently given a clean bill of health by an Abeokuta High court in a similar case filed against him by the anti-graft agency.   

“I hereby give my consent to the Federal Government of Nigeria to prefer information against the above-named accused person,” Justice Olopade said.

The EFCC has had to seek the leave of the court to prefer information against Daniel after Justice Olanrewaju Mabekoje of the Ogun State High Court dismissed the 43 count information leveled against the former governor because the Commission purportedly failed to seek the leave of the court to file the amended information.

However, with the consent given by the state chief judge, Gbenga Daniel would now be arraigned before Justice Mabekoje on April 16, 2012 in Abeokuta on 38 count information that borders on abuse of office and misappropriation of public funds when he held sway as the governor of the state.
